Understanding the Right Process for Your Funds

Blue Harbor Asset Group helps potential claimants identify the type of funds involved, where the funds may be held, and which administrative requirements may apply. Each matter is reviewed individually.

Three Sources. Three Different Processes.

State-held unclaimed property, property-tax-sale excess proceeds, and mortgage trustee-sale surplus are governed by different rules. We first identify the category before determining whether Blue Harbor Asset Group can offer assistance.

1. California State-Held Unclaimed Property

This category includes financial property transferred to the California State Controller’s Office, such as uncashed checks, dormant accounts, insurance proceeds, securities, and other intangible property. It does not include real estate. Owners and heirs may search for and claim State-held property directly from the State Controller’s Office at no charge. For legally eligible matters, Blue Harbor Asset Group may review public records, identify relevant property records, explain documentation requirements, help organize authorized claim materials, and provide permitted follow-up. Before services begin, the claimant receives the required written disclosures and fee terms. No advance service fee is charged, and any investigator fee is subject to California law and generally cannot exceed 10% of the property returned.

2. California Property-Tax-Sale Excess Proceeds

Property-tax-sale excess proceeds may remain when a county sells tax-defaulted property for more than the taxes, penalties, fees, and sale costs. A claimant’s entitlement depends on their legally recognized interest and priority; recorded lienholders generally have priority before former record owners. Claims generally must be filed within one year after the tax collector’s deed is recorded. Parties of interest may file directly with the county at no cost. When Blue Harbor Asset Group offers assistance, we disclose the reported amount and source of the proceeds, review the county’s requirements, help organize supporting records, and provide authorized administrative follow-up. The county or its board of supervisors makes the final decision.

3. California Mortgage Trustee-Sale Surplus

Mortgage trustee-sale surplus may remain after a nonjudicial foreclosure sale. Sale costs, the foreclosing obligation, and qualifying junior liens are generally paid before any balance is distributed to the former owner or another legally entitled party. California imposes special restrictions on residential trustee-sale surplus matters, including a 90-day restriction on initiating contact with an owner after the trustee’s deed is recorded. California law may also prohibit compensated recovery agreements by foreclosure consultants. Blue Harbor Asset Group does not enter a direct compensated recovery agreement for a California residential trustee-sale matter unless a qualified California attorney has reviewed the specific facts and confirmed a lawful role. When appropriate, we may provide general public-record information or facilitate contact with independent California counsel. No legal representation or recovery is promised by Blue Harbor Asset Group.

How Our Review Begins

First, we identify whether the funds are held by the State Controller’s Office, a county tax collector, a foreclosure trustee, or a court. We then review available public records without representing that entitlement has been confirmed.

Written Terms and Authorized Support

We determine whether Blue Harbor Asset Group may lawfully offer assistance and explain the proposed scope of service. Before eligible work begins, the claimant receives the appropriate disclosures, direct-claim information, written fee terms, and authorization documents. Mortgage-residence matters require attorney review before any compensated recovery role is considered.

Official Review and Payment

For eligible matters, we help organize supporting documentation and provide only the follow-up authorized by the claimant and permitted by law. The State Controller’s Office, county, trustee, or court—not Blue Harbor Asset Group—determines eligibility, priority, approval, distribution method, and payment timing.

Can I file a claim without Blue Harbor?

Yes. Owners, heirs, and other parties of interest may contact the government office, county, trustee, or court holding the funds and may submit their own claim without hiring Blue Harbor. State-held unclaimed property claims may be filed directly with the California State Controller’s Office at no charge, and tax-sale claims may be filed directly with the county at no cost.

Who determines eligibility and payment?

The State Controller’s Office, county, foreclosure trustee, or court holding the funds determines eligibility, priority, required documentation, approval, distribution, and payment timing. Blue Harbor does not make those decisions.

Is Blue Harbor a government agency or law firm?

No. Blue Harbor Asset Group is a private company. We are not affiliated with the California State Controller’s Office, any county, court, tax collector, or foreclosure trustee, and we are not a law firm. Our services are optional.

Are results or processing times guaranteed?

No. Eligibility, priority, approval, recovery, payment method, and processing time are controlled by the office holding the funds and depend on the facts and documentation. Blue Harbor does not guarantee approval, recovery, or timing.
