1. Website and Company
These Terms and Conditions govern your use of blueharborassetgroup.com (the “Website”), which is operated by Blue Harbor Asset Group LLC (“Blue Harbor,” “we,” “us,” or “our”). By using the Website, you agree to these Terms. If you do not agree, please discontinue use of the Website.
2. Website Information and Separate Service Agreements
The Website provides general information about possible unclaimed property and surplus-fund matters. Submitting a form, calling, texting, or communicating with Blue Harbor does not establish a client relationship, confirm eligibility, or obligate Blue Harbor to provide services.
Any recovery-related services will be governed by a separate written agreement containing the disclosures, authorizations, fee terms, and other provisions required for the particular type of matter. If a separate service agreement applies, that agreement controls the services; these Terms continue to govern use of the Website.
3. Private Company; No Government Affiliation
Blue Harbor is a private company. We are not the California State Controller’s Office, a county, court, tax collector, foreclosure trustee, or any other government agency, and we are not affiliated with or endorsed by those offices. Registration as an investigator with the California State Controller’s Office does not make Blue Harbor a government agency or an official representative of the State.
4. No Legal, Tax, or Financial Advice
Blue Harbor is not a law firm and does not provide legal representation or legal, tax, or financial advice. Website information is general and may not apply to a particular matter. When legal interpretation, probate proceedings, contested ownership, lien priority, foreclosure restrictions, or court representation may be involved, you should consult an independently selected qualified attorney or other licensed professional.
5. Different Types of Funds
California State-held unclaimed property. State-held unclaimed property generally consists of financial property transferred to the California State Controller’s Office and does not include real estate. Owners and heirs may search for and claim this property directly from the State Controller’s Office at no charge. Blue Harbor offers assistance only when permitted by law and under a compliant written agreement. No advance service fee is charged for this service, and an investigator fee generally cannot exceed 10% of property actually returned.
California property-tax-sale excess proceeds. Excess proceeds may remain after a county sells tax-defaulted property. Parties of interest may file directly with the county at no cost. Claims generally must be filed before one year expires following recordation of the tax collector’s deed. Eligibility and payment depend on legally recognized interests and priority. When Blue Harbor lawfully assists, the reported amount and source of the proceeds and the right to file directly with the county at no cost will be disclosed as required.
California mortgage trustee-sale surplus. Surplus may remain after a nonjudicial foreclosure trustee’s sale. California law prohibits contacting, soliciting, or initiating communication with an owner to claim surplus funds from the foreclosure sale of the owner’s residence before 90 days after the trustee’s deed is recorded. California law also restricts foreclosure consultants from entering compensated agreements to recover such surplus. Blue Harbor will not undertake a compensated recovery role in a California residential trustee-sale matter unless a qualified California attorney has reviewed the facts and confirmed a lawful role.
6. No Determination or Guarantee
A name, address, or public-record match does not establish ownership, priority, eligibility, or entitlement. The State Controller’s Office, county, trustee, or court holding the funds—not Blue Harbor—determines required documentation, eligibility, priority, approval, distribution, payment method, and timing.
Blue Harbor does not guarantee that funds exist, that a person is entitled to receive them, that a claim will be approved, the amount that may be paid, or how long review or payment may take.
7. Direct Filing and Optional Services
Blue Harbor’s services are optional. Customers may contact the office holding the funds and may submit their own claims when permitted. State-held unclaimed property claims may be filed directly with the California State Controller’s Office at no charge, and property-tax-sale claims may be filed directly with the applicable county at no cost. Blue Harbor will provide direct-filing information and required disclosures before an eligible service agreement is signed.
8. User Responsibilities
You agree to provide accurate and complete information and to use the Website only for lawful purposes. You may not interfere with the Website, attempt unauthorized access, transmit harmful code, impersonate another person, or submit information that you do not have authority to provide.
Do not send Social Security numbers, government identification, banking information, passwords, or other highly sensitive documents through a general website contact form unless Blue Harbor specifically provides an approved secure method.
9. Fees and Payment Terms
No fee is created merely by visiting the Website or submitting an inquiry. Any fee for an eligible matter must be stated in a separate written service agreement and is subject to applicable law. Website descriptions do not modify a signed service agreement or authorize a fee that the law does not permit.
10. Calls and SMS Messages
Providing a telephone number does not by itself enroll you in marketing messages. When you separately and affirmatively opt in, you consent to receive recurring informational and, if specifically authorized, promotional calls or text messages from Blue Harbor at the number provided, including messages sent using automated technology. Consent to marketing messages is not a condition of purchasing or receiving services. Message frequency varies. Message and data rates may apply.
You may revoke consent at any time by replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE, or by using another reasonable method that clearly requests messages to stop. Carriers are not responsible for delayed or undelivered messages. You represent that you are the subscriber or authorized user of the telephone number provided.
11. Privacy

12. Intellectual Property
The Website’s original text, graphics, branding, design, and other content are owned by or licensed to Blue Harbor and are protected by applicable intellectual-property laws. You may use the Website for personal, noncommercial informational purposes. You may not reproduce, sell, distribute, or create derivative commercial works from Website content without written permission.
13. Third-Party and Government Websites
The Website may link to government offices or third-party websites for convenience. Blue Harbor does not control third-party content, availability, security, or privacy practices. A link does not imply affiliation or endorsement. Users should verify current requirements directly with the government office or other organization responsible for the information.
14. Disclaimer and Limitation of Liability
The Website is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Blue Harbor disclaims warranties regarding uninterrupted availability, completeness, accuracy, or fitness for a particular purpose. Laws, forms, deadlines, and government procedures may change, and users should verify current requirements with the responsible office.
To the maximum extent permitted by law, Blue Harbor will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to use the Website. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits rights provided by applicable consumer law. This Website limitation does not replace or alter obligations expressly stated in a separate signed service agreement.
15. Changes to These Terms
We may update these Terms by posting a revised version and effective date on this page. Changes apply prospectively from the posted effective date. Continued use of the Website after an update constitutes acceptance of the revised Website Terms.
16. Governing Law and Severability
California law governs these Terms, without regard to conflict-of-law principles. If any provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
